What are the ignition interlock device requirements after a DWI?

On Behalf of | Jan 28, 2025 | Drunk Driving

If you face a DWI charge in New Jersey, you may encounter the requirement to install an ignition interlock device (IID). This device plays a significant role in preventing further alcohol-related driving offenses. Here’s what you need to know about how it works and the state’s requirements.

What is an ignition interlock device?

An ignition interlock device is a small breath tester installed in your vehicle. It prevents your car from starting until you provide a breath sample showing no measurable alcohol content. If the device detects alcohol, the car won’t start. Additionally, you may need to submit periodic samples while driving to ensure continued compliance.

When is an IID required?

In New Jersey, IIDs are mandatory for many DWI convictions. For a first offense, the requirement depends on your blood alcohol concentration (BAC) at the time of arrest. If your BAC is 0.15% or higher, you must install an IID during your license suspension and for six months to a year after reinstatement. Lower BAC levels may also result in an IID order, especially if the court deems it necessary.

Repeat offenses carry stricter IID requirements. Second and third DWI convictions generally require installation during license suspension and for 1-3 years after your driving privileges are restored.

What are the costs and responsibilities?

As the driver, you’re responsible for all IID costs, including installation, maintenance, and monthly fees. These expenses can add up, but they’re required to regain and maintain your driving privileges. You must also ensure the device remains functional and undergo regular calibration checks as specified by the provider.

Staying compliant

If you are convicted of a DWI, you must comply with IID requirements to avoid additional penalties. If you attempt to tamper with or bypass the device, you may face fines or further license suspensions. Compliance ensures you can keep driving legally and avoid further legal trouble.
